A man faces several DUI charges after he was arrested under a warrant penned by the Cape Coral Police Department’s Major Crash investigators.

This case, stemming from a crash on April 19th 2020, was sent to the State Attorney’s Office for a warrant request which came back approved on October 19th, 2020. On November 9th, 2020 at approximately 2:30 am the driver of Vehicle 1, Mathaniel Allen Tuller, was taken into custody by the Fort Myers Police Department based on CCPD Major Crash Investigator Barkley’s original warrant.

Tuller has been charged with DUI Causing Serious Bodily Injury in violation of FL Statute 316.193 (3c2), DUI with a BAC of .15% or higher in violation of FL Statute 316.193 (4), and two counts of DUI Causing Property Damage in violation of FL Statute 316.193 (3c1). 

Additionally, the driver of Vehicle 2, Javier M. Flores was issued a criminal citation for Operating a Motor Vehicle with No Driver License (never issued one) in violation of FL Statute 322.03 (1) and was also issued two citations for the two children that were not in car seats in violation of FL Statute 316.613 (1a).
