Charges Brought Against Driver in September High-Speed Crash

A driver whose speed and reckless actions caused a serious wreck with injuries in September is now facing charges.

From the Major Crash Investigator:

Today at 3:00 p.m., Jivon Rodriguez (W/M, DOB: 1-27-98, of 3328 Diana Drive, Zephyrhills, FL) met the investigating officer to surrender himself for the charges of Reckless Driving Causing Serious Bodily Injury and Reckless Driving Causing Property Damage. The charges came as a result of a two-vehicle crash on September 24th, 2019 at the 1400 block of Del Prado Blvd South.

Based on the investigation, it was determined that Rodriguez piloted his father’s highly modified Nissan 300ZX to a minimum speed of 102 MPH in the 45MPH zone of 1300 Del Prado Blvd South at approximately 1:10 pm. This reckless speed resulted in an impact with a Ford Edge driven by Franklin Mihacy, at speeds between 82 MPH and 93 MPH, as Mihacy crossed Del Prado Blvd. The impact resulted in serious bodily injuries to Franklin Mihacy. 

It is further determined that had Rodriguez been traveling at the speed limit of 45 MPH, at the point in which Mihacy began to cross Del Prado, the crash would have been avoided by a distance of 120 feet with Rodriguez continuing at 45 MPH with no corrective action.

Speed is considered to be the primary factor in this collision.

Rodriguez was booked at the Cape Coral Police Department before being transported to the Lee County Jail.
