Victim Takes Gun Away From Suspect After Being Battered

On April 5, 2019, around 3:45 am, Cape Coral Police responded to a call for service in reference to a disturbance with weapons at 2108 NE 33rd Terrace.

Officers met with the victim who was invited to 2108 NE 33rd Ter by the female home owner after a night out. The victim was standing in the kitchen eating when Gordon Alton Smith (W/M, DOB: 01/12/1977, 2108 NE 33rd Ter), who also lives at the home, approached the victim for an unknown reason.

Smith became upset that the victim was in the residence and began yelling. Smith then told the victim that he was going to get a gun. He then left the kitchen and returned with what was later identified as a black Titan .25 caliber handgun. Smith struck the victim in the face twice with the handgun. The victim was then able to take the gun away from Smith and flee the house to call 9-1-1 for help.

An officer took possession of the handgun which was loaded with six rounds but had an empty chamber.

Smith was charged with Aggravated Battery with a Deadly Weapon and Aggravated Assault with a Deadly Weapon without Intent to Kill.

He was transferred to Lee County Jail.
