A victim was in the wrong place at the wrong time when he was misidentified by the suspect as a person who earlier caused property damage.
On January 24, 2019, around 8:28 PM, Cape Coral Police responded to a call for service at the intersection of SE 5th PL and SE 46th ST in reference to a disturbance in progress.
The physical disturbance was between two males where one of the males had got into a vehicle and attempted to hit the victim with it.
The victim had stopped his vehicle to locate a phone that had been tossed out the window by mistake. As he was attempting to locate the cellular telephone in the grass, a black GMC pick up truck pulled up and Michael Ernest Brennan (W/M, DOB: 09/17/1953, 4563 SE 5th Place) got out.
Brennan confronted the victim about possible property damage that was done to the condominium complex earlier that day in which Brennan lives and in front of which they were currently parked. Brennan told the victim to leave, then came up behind him as he was walking away and punched him in the back of the head. Brennan then used both his hands and shoved the victim, trying to push him to the ground. The victim turned around and punched Brennan in the face and walked away.
Brennan got back into his truck and attempted to “push” the victim with the truck to get him off the property while they were on the side of the condominium complex. Officers could still see tire marks on the grass and on the street that lead to where the truck was parked.
Due to the investigation and evidence at the scene, Brennan was placed under arrest and charged with Aggravated Assault with a Deadly Weapon and Battery. He was later transferred to Lee County Jail.
